Privacy Policy

Luxivana Privacy Policy outlines how Luxivana Exchange Pty Ltd ACN 689 348 454 and all its related entities (“Luxivana”, “we”, “us”, or “our”) manage personal information that we collect from (“Members”, “potential Members”, “you” or “your”)  for the use of the Luxivana Platform (ARSN 689 348 454), including our website, in accordance with the Australian Privacy Principles (APPs) under the Privacy Act 1988 (Cth). 

This document is to be read in conjunction with the Luxivana PDS, Terms and Conditions and the Luxivana Platform Constitution. Unless notified otherwise, we assume you have consented to the collection of all information provided to us by you in accordance with this Privacy Policy. 


Types of Information Collected

The type of personal information we collect may include but not limited to the following:

  • Personal details: name, age, date and place of birth, address, email address and phone numbers 
  • Financial details: bank account, credit/debit card information
  • Identification documents: driver’s license, passport, birth certificate
  • Sensitive information (e.g., tax file number) for compliance with Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth) (AML/CTF Act) 
  • Usage data from the Luxivana platform (IP address, browser, data and time of visit, access and actions during visit)  

We will not be able to provide you with the products and services you request if you do not provide us with all the information we requested. 


Collection and Consent

Information we collect during registration is required so you can use the platform and enable you to transact with us and acquiring an interest in Luxivana investments. 

By you completing and submitting an online application, you consent to Luxivana disclosing your information to service providers for the purpose referred to as described in this Privacy Policy.  

You can access and update your personal information by visiting www.luxivana.com/login, click on ‘My Account’ followed by ‘Settings’ or alternatively contact Luxivana at info@luxivana.com.  

We will notify you prior the collection of your personal information to refer to this Privacy Policy. Where we are legally obliged to collect or disclose your personal information to a third party, we will notify you. 


Electronic Disclosure

Engagement with us is primarily conducted online, with communications and account management facilitated through the Luxivana platform and email correspondence.

When registering on the Luxivana platform, you are required to provide a valid email address. This email is where we send you important information regarding your Luxivana account and your investments. By supplying this email address, you consent to receiving documentation (such as membership confirmations, updates, promotional material, and financial content) at that address (or any alternative email you later update in your Luxivana account settings).


Use and Disclosure

Luxivana collects personal information to operate our business and to deliver the products and services you request. We use or disclose this information for the purpose it was collected and may also use it for secondary purposes that you would reasonably expect. 

In certain cases, we may be required or permitted to use or disclose your personal information under Australian law or by order of a court or tribunal. Sensitive information will only be disclosed for a secondary purpose if it is directly connected to the original purpose for collection, or if we are legally obligated to do so.

Luxivana uses personal information to verify identity, manage investments and relationships, third-party’s relations, quality assurance and staff training, communicate updates, enhance services, meet legal obligations, and identify relevant offerings.

Where it is necessary for us to engage third party to supply services, we take reasonable steps to confirm that third parties that we deal with are also compliant with the Privacy Act before we disclose your personal information to them. 

Your personal information will only be shared with third parties when legally required or shared with trusted service providers such as auditors, consultants, or advisors for purposes directly related to managing your investment or in the event of business transfers (merger, acquisition, or sale), your information may be transferred as part of that transaction. 

Under no circumstances, Luxivana sell personal information. 


Cross-Border Disclosure

Luxivana does not send your personal information to overseas recipients unless under the following circumstances:  

  • The recipient is governed by privacy laws or frameworks that offer protections comparable to the Australian Privacy Principles (APPs);
  • The disclosure is required or permitted under Australian law or a court/tribunal order;
  • The transfer is necessary to fulfil a contract with you; or
  • The transfer is in your best interest and meets all applicable privacy requirements

We will take reasonable steps to ensure overseas recipients comply with privacy standards similar to APPs (including entering into a written contract with them) before any disclosure can be made. 


Sensitive & Unsolicited Information

We only collect sensitive information to the extent it is reasonably necessary for our function, and we have your prior consent. 

Unsolicited information is handled according to APPs and this Privacy Policy and will be destroyed or de-identified as appropriate if it could not have been collected by a permitted means. 


Direct Marketing

We may use and disclose your personal information to keep you informed of our product and service offerings. You may receive promotional materials from us (such as offers, events, updates, articles, newsletters) and invitation to subscribe to our blog and social media. 

Opt-out options of receiving direct marketing are available via settings in your Luxivana My Account or unsubscribe links. 


Data Storage and Protection

To protect your personal information from misuse, interference and loss, unauthorised access, modification or disclosure, your personal information is stored securely using encryption and access controls. Access is limited to authorized personnel of Luxivana including officers, agents, service providers, contractors and employees of Luxivana on a need-to-know basis. All employees of Luxivana are required maintain the confidentiality of any personal information they handle.

We require non-disclosure agreements to be executed with other parties that provide support services to Luxivana to ensure we safeguard your personal information.  

Your personal information is destroyed or de-identified when no longer needed or required to be maintained. 


Access and Correction

You can request access or corrections to your personal information by contacting Luxivana.

Luxivana will refuse access under certain legal conditions where providing access would be:  

  • unreasonably impacting on the privacy of other individuals 
  • unlawful, or where denying access is required or authorised by an Australian law or a court order
  • interfering with law enforcement activities 

Where we have reasons to suspect that unlawful activity or serious misconduct is being or may be engaged in and giving access would likely prejudice the taking of appropriate action, we will refuse access. 

You can ask us to correct your personal information, and we will respond to your request within a reasonable time. However, we may refuse access to your information or refuse a correction request where there are legal, regulatory or administrative reasons to deny access. If this occurs, we will provide you with a written notice stating reasons for the refusal to the extent it would be reasonable for us to do so along with the mechanism available to complain about the refusal.

Cookies and Analytics

Luxivana use platform analytics software provided by an external service provider to monitor website traffic, patterns and also survey users to continuously improve the Luxivana platform. Information we gather is not personally identifiable. 

Cookies help us determine the type of browser and settings you use, your movements/actions within the platform, and to ensure your information is secure. We use the information obtained to enhance user experience, including tailoring to your needs and preferences when navigating the platform. 

You can manage cookies preferences via browser settings. However, you may not be able to access some parts of platform if you disable the cookies acceptance on your browser. We recommend you enable cookie acceptance to ensure you can access all services on the Luxivana platform.  


AML/CTF Compliance

Your personal information may be collected before we can provide a product or service to you. This is done to ensure we comply with our customer identification obligations under the AML/CTF Act. 

We will be required to collect identification information such as name, residential address and date of birth and in some cases, we may need to determine if you are political exposed persons for the purposes of AML/CTF Act. When this information is provided to us when asked, we will infer your consent to use and disclose the information for this purpose. 

We may need to further collect or clarify and update your personal information including individual financial information which we will collect directly from you or from third party sources. Our Terms and Conditions has further details on information about our obligations and your rights in relation to the disclosure to a credit reporting agency.

If you do not want us to disclose your personal information to a credit reporting agency for this purpose, you have the right to inform us via email at info@luxivana.com and you can opt for an alternative means of identifying for AML/CFT Act purposes.

This Privacy Policy is reviewed periodically to reflect legal, technology operational changes and is publicly available on our Platform at www.luxivana.com/privacy 

This Privacy Policy was last updated on 16 July 2025. 


Enquiries and Complaints

If you would like to make any enquiry or complaint in relation to your information handling, or about a breach of the APPs that binds Luxivana, please contact our Customer Service at info@luxivana.com. We aim to respond to complaints within 30 days.
